Official Policy Version 3.3

Terms of Service

How we protect your journals, power your stories, and safeguard your thoughts through end-to-end encryption.

Last updated: October 19, 2026 Effective immediately upon access
01 / Journals

Private vs. Open

Stories stay in private journals until you choose otherwise. Open journals are public and delivered directly to followers in the app & via email.

02 / Secrets

End-to-End Encryption

Secrets uses zero-knowledge end-to-end encryption locked by your 6-digit passcode. We hold no keys. If you lose your passcode, your stories cannot be recovered.

03 / Ownership

100% Your Property

You retain total ownership of your writing, photos, and voice notes. We do not sell your personal stories or train public AI models on your private writing.

Notice: Please read these Terms of Service carefully before using SocialGem. By accessing the application, website, APIs, or publishing networks, you agree to be bound by these provisions.

1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the SocialGem mobile applications, web platforms, APIs, email distribution systems, and related services ("Services") provided by SocialGem ("we", "us", or "our").

By creating an account, browsing open stories, or accessing our applications, you enter into a legally binding contract with SocialGem. If you do not agree to these Terms, you must not use our Services.

2. Accounts and Eligibility

You must be at least 13 years old (or the legal age of digital consent in your jurisdiction) to use SocialGem. By registering, you confirm that you meet this requirement.

You are responsible for keeping your login credentials safe. You accept responsibility for all activity that occurs under your account. If you believe your account has been compromised, notify us immediately at security@socialgem.net.

3. Stories and Journals Architecture

SocialGem organizes your writing into clear structures:

  • Story: Any single write-up, thought, reflection, voice recording, image collage, video clip, mood chip, or music pairing created on SocialGem.
  • Private Journal: A personal journal that only you can access with your login credentials. Stories inside private journals are never shown on public feeds, discovery decks, or search engines.
  • Open Journal: An independent, public publication that lives on the web and in the app. Anyone can follow an open journal to read its stories and receive new updates.
  • Secrets: A dedicated private journal protected by zero-knowledge end-to-end encryption.

4. Secrets: End-to-End Encryption Protocol

Secrets is an end-to-end encrypted private journal designed for your most personal truths. It uses local, on-device AES-256 END-TO-END ENCRYPTION (E2EE).

  • CLIENT-SIDE END-TO-END ENCRYPTION: Every story title, body, and text block inside Secrets is encrypted directly on your physical device before transmission. Only scrambled ciphertext is stored on our servers.
  • ZERO SERVER KEYS: Your 6-digit passcode stays in your local device memory. It is never transmitted across the network or stored in our cloud databases. We have zero mathematical ability to decrypt or view what you write in Secrets.
  • IRRECOVERABILITY: If you lose or forget your 6-digit passcode, your secret stories are permanently lost. SocialGem cannot reset your passcode, bypass the encryption, or restore your plaintext stories.
  • PERMANENT RESET PROTOCOL: Resetting a forgotten passcode requires an intentional 2-second continuous hold. Doing so executes a cryptographic wipe that permanently deletes all previous secret stories to ensure nobody else can ever read them.

5. Open Journals and Email Delivery

When you publish a story inside an Open Journal, you are choosing to share it with the world. Open journals can be read on the web, indexed by search engines, and shared across the internet.

Readers can follow to your Open Journal from the app or using their email address without downloading the SocialGem app. By publishing a story to an open journal, you authorize SocialGem to send that story directly to your Followers email inboxes.

Moving a story from a private journal into an open journal requires a deliberate action. Once a story is delivered to your followers inboxes via email, those delivered copies cannot be recalled.

6. Content Ownership and License

You own your stories completely. SocialGem claims no ownership or copyright over your writing, photos, voice recordings, or ideas.

You grant us a limited, worldwide license to host, cache, format, and transmit your content solely to run the platform. This includes syncing your private journals across your devices, displaying your open journals on the web, and delivering stories to your followers.

This license ends as soon as you delete a story or close your account. We never sell your personal stories or use your private writing to train public AI models.

7. Quest Personal Intelligence

Quest is built as a personal companion to offer writing prompts, assist your drafts, and help you through your daily life.

Important: Quest is personal software, not a human professional. Quest does not provide medical diagnoses, psychiatric therapy, mental health crisis counseling, legal advice, or financial planning.

AI outputs may occasionally contain errors. You are responsible for reviewing and confirming any content or suggestions generated by Quest before relying on them or publishing them into a story.

8. Media, Voice Notes and Music

You are responsible for the files you upload. You confirm that you have the right to share the images, videos, and voice recordings you attach to your stories. Individual files must not exceed 50 MB.

SocialGem allows you to attach songs to your stories. These clips are short promotional previews provided through licensed music partners. Attaching a song gives you no copyright ownership over the music, and track availability may change based on region or licensing terms.

9. Acceptable Use Standards

You agree not to use SocialGem to publish or share material that:

  • Is illegal, fraudulent, or promotes criminal activity.
  • Contains child exploitation or non-consensual sexual imagery.
  • Threatens violence, incites self-harm, or encourages suicide.
  • Harasses, stalks, or malicious doxxes individuals.
  • Distributes viruses, malware, or automated spam.

We reserve the right to remove public stories or suspend accounts that violate these rules.

10. Gem+ and Storage Quotas

SocialGem provides free baseline storage (up to 5 GB). Optional paid Gem+ memberships expand cloud storage (50 GB, 200 GB, and 1 TB tiers), unlock page scans, and increase private journal limits.

Subscriptions purchased in our mobile apps are processed through official application stores (Apple App Store and Google Play). They automatically renew until canceled in your store account settings.

If your account exceeds its storage quota, it enters a read-only state. Your existing stories remain safe and readable, but you will not be able to upload new media until you free up space or upgrade your plan.

11. DMCA Copyright Policy

We respect intellectual property rights. If you believe your copyright is being infringed upon by a story published in an Open Journal, send a notice to our copyright agent at dmca@socialgem.net containing:

  1. A description of the copyrighted work you claim has been infringed.
  2. The specific URL or location of the infringing story on SocialGem.
  3. Your contact information (name, email address, and phone number).
  4. A statement that you have a good-faith belief the use is unauthorized.
  5. A statement made under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

12. Termination and Data Erasure

You may delete your account at any time in your settings. When deleted:

  • Your profile and login credentials are permanently deactivated.
  • Your private journals, secrets, and draft stories are removed from active databases.
  • Your open journals and public stories are taken off the web.
  • Routine backup copies are overwritten according to our standard technical retention schedule.

13. Disclaimers

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that the Services will always be uninterrupted, error-free, or completely secure from external attacks. You use the service at your own discretion.

14. Limitation of Liability

To the fullest extent permitted by law, SocialGem shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, loss of access resulting from forgotten Secrets passcodes, or service interruptions.

Our total aggregate liability for any claim related to these Terms will not exceed the amount you paid us over the past twelve months, or fifty US dollars ($50.00), whichever is greater.

15. Dispute Resolution

If you have an issue with the service, you agree to contact us informally at disputes@socialgem.net so we can attempt to resolve it first.

Any formal legal disputes arising from these Terms will be handled through individual binding arbitration, rather than in court, and you agree to bring claims only on an individual basis and not as part of a class action.
